MUI asks National Police Chief to be wise in responding edict

REPUBLIKA.CO.ID, JAKARTA -- Chairman of Fatwa Commission Indonesian Council of Ulama (MUI), Hasanuddin AF, asked National Police Chief General Tito Karnavian to be wise on the fatwa regarding prohibition to wear other religious attributes for Muslims. 

He said it to response a warning and sanction given by the National Police Chief to Chief of Bekasi Metro Police (West Java) and Kulonprogo (East Java). Hasanuddin saw the sanction against the two police chief and statement related to the fatwa was not a positive law could lead to misinformation in the society. "As if the edict issued by MUI was wrong and did not have to be obeyed," he said to Republika.co.id, on Tuesday.

Hasanuddin stressed the edict was issued for Muslims. National police has the right to follow nor sideline it.  "The National Police Chief has to be wise. This edict issued by MUI, therefore it was the ulama's authority. Before judging the edict do not have to be a reference, they should coordinate with MUI," Hasanuddin.

Meanwhile, in a joint press conference with National Police Chief on Tuesday night, MUI Chairman KH Ma'ruf Amin, said MUI hopes the government will take part in this case. Therefore, MUI did not justify sweeping done by certain parties. "It could only be done by the authority," Ma'ruf said.

Meanwhile, Vice President Jusuf Kalla has said that the fatwa prohibiting Muslims to wear other religious attributes s not a law so there is no obligation to enforce it. He explained if someone violates the religious ruling, the punishment is sin and hell. "It is a religious ruling, always for onself," he remarked in different occasion.

يَسْتَفْتُوْنَكَۗ قُلِ اللّٰهُ يُفْتِيْكُمْ فِى الْكَلٰلَةِ ۗاِنِ امْرُؤٌا هَلَكَ لَيْسَ لَهٗ وَلَدٌ وَّلَهٗٓ اُخْتٌ فَلَهَا نِصْفُ مَا تَرَكَۚ وَهُوَ يَرِثُهَآ اِنْ لَّمْ يَكُنْ لَّهَا وَلَدٌ ۚ فَاِنْ كَانَتَا اثْنَتَيْنِ فَلَهُمَا الثُّلُثٰنِ مِمَّا تَرَكَ ۗوَاِنْ كَانُوْٓا اِخْوَةً رِّجَالًا وَّنِسَاۤءً فَلِلذَّكَرِ مِثْلُ حَظِّ الْاُنْثَيَيْنِۗ يُبَيِّنُ اللّٰهُ لَكُمْ اَنْ تَضِلُّوْا ۗ وَاللّٰهُ بِكُلِّ شَيْءٍ عَلِيْمٌ ࣖ
Mereka meminta fatwa kepadamu (tentang kalalah). Katakanlah, “Allah memberi fatwa kepadamu tentang kalalah (yaitu), jika seseorang mati dan dia tidak mempunyai anak tetapi mempunyai saudara perempuan, maka bagiannya (saudara perempuannya itu) seperdua dari harta yang ditinggalkannya, dan saudaranya yang laki-laki mewarisi (seluruh harta saudara perempuan), jika dia tidak mempunyai anak. Tetapi jika saudara perempuan itu dua orang, maka bagi keduanya dua pertiga dari harta yang ditinggalkan. Dan jika mereka (ahli waris itu terdiri dari) saudara-saudara laki-laki dan perempuan, maka bagian seorang saudara laki-laki sama dengan bagian dua saudara perempuan. Allah menerangkan (hukum ini) kepadamu, agar kamu tidak sesat. Allah Maha Mengetahui segala sesuatu.”

(QS. An-Nisa' ayat 176)
