NGO files lawsuit against Corby's clemency

REPUBLIKA.CO.ID, JAKARTA – The National Movement of Anti-Drugs (Granat) filed a lawsuit to Jakarta State Administrative Court (PTUN) against the clemency for drug convicts, Schapelle Leigh Corby and Peter Achim Franz Grobmann.

The Chairman of Granat, Henry Yosodiningrat, along with the attorney, Yusril Ihza Mahendra, came to the PTUN on Thursday. Yosodiningrat said the lawsuit was filed against Presidential Decree No. 22/G/2012 dated May 15, 2012 on the clemency as it violated public norms which firmly fight against drugs.

"Government should have shown its commitment on fight against drugs through fair law enforcement," he said then added, the clemency did not reflect justice, protection of human rights, and law certainty.

Meanwhile, Mahendra said the lawsuit needed to be filed as it met certain criteria, like concrete, individual, and final. "The verdict will be individual because it is not for general. It is specifically for Corby and Grobmann," Mahendra said.

The clemency is also final because it does not need any approval from other instances because President holds the highest power of government according to Constitution of Indonesia. The clemency, he added, was contradictory with general principles of good government. The principles are law certainty, openness, proportionality, professionalism, and accountability as cited on Laws No. 28/1999.

Ketika Ibrahim berkata, “Tuhanku ialah Yang menghidupkan dan mematikan,” dia berkata, “Aku pun dapat menghidupkan dan mematikan.” Ibrahim berkata, “Allah menerbitkan matahari dari timur, maka terbitkanlah ia dari barat.” Maka bingunglah orang yang kafir itu. Allah tidak memberi petunjuk kepada orang-orang zalim.
