REPUBLIKA.CO.ID, JAKARTA - Constitutional Court announced on Tuesday that upstream oil and gas regulator BP Migas was unconstitutional. All articles related to the regulatory body in Laws No. 22/2001 on Oil and Gas violated the 1945 Constitution and therefore it did not have legal grounds, the Chief Justice of Constitutional Court, Mahmud MD, said.
"All of its functions and duties will be handed over to related Ministry until new laws are enacted," he said on Tuesday.
Deputy Control Operation at BP Migas, Gde Pradyana, confirmed the dismissal on his text to Republika. He said that BP Migas would give the next step to Minister of Energy and Mineral Resources. He also said that it was important to appoint a body to control and monitor the agreement of contract.
