REPUBLIKA.CO.ID, JAKARTA -- Minister of Women Empowerment and Child Protection, Yohana Yembise said Indonesia has a strong commitment to ensure the protection of children through regulatory and policy framework, both nationally, and internationally.
Yohana’s statement related to the rejection of marriageable age limit increase, from 16 years to 18 years, by the Constitutional Court (MK). Yohana explained regulations in Indonesia that have been set related to it, were Law Number 35 of 214 on Protection of Children at the national level. While at the international level, she continued, there was the Convention on the Rights of the Child.
"In international law, the marriage of the children age has been established as one of the violence forms against women and a violation of human rights (HAM)," said Yohana, on Friday, June 19.
Therefore, she regretted the decision of the Constitutional Court which refused to raise the marriageable age limit, from the age of 16 years to 18 years. Because, Yohana rated, there were many effects or harmful effects that might be born as a result of the relationship, both in the psychological and health.
MK in its consideration of verdict that was read on Thursday, June 18, was rejecting judicial review of Law Number 1 of 1974 on Marriage, namely Article 7, paragraph 1. Constitutional Assembly said there was no guarantee of an increase in the age limit of married from 16 years to 18 years for women, will be able to reduce the problem of divorce, health, and social.
