REPUBLIKA.CO.ID, JAKARTA -- Otto Cornelis (OC) Kaligis was sued 10 years in prison and a fine of Rp 500 million with subsidiary 4 months in prison in a case of alleged bribery to the judge and the clerk of State Administrative Court of Medan, North Sumatra.
As is known, in this case, Kaligis was accused of bribing three Administrative Court judges of Medan. The first was chairman of the panel of judges, Tripeni Irianto Putro, for five thousand Singapore dollars and 15 thousand US dollars.
Then, the other were two members of the panel of judges, namely Dermawan Ginting and Amir Fauzi for each 5 thousand US dollars. The last was the clerk of the Administrative Court, Yusfan Syamsir, for two thousand US dollars. So that the total bribe was 27 thousand US dollars and five thousand Singapore dollars.
However Kaligis only admitted to give 1,000 US dollars to Syamsir Yusfan. The purpose of giving the money, according to the prosecutor, was to change the decision on petition for the authority of the High Court of North Sumatra on investigation of corruption on Fund of Social Assistance, Region Liege Assistance, School Operational Assistance, and Capital Participation in a number of regional enterprises in North Sumatra Provincial Government.
OC Kaligis's case was a corruption act that is stated in Article 6 paragraph 1 letter a or Article 13 of Law No. 31, as amended by Act No. 20 of 2001 on Corruption Eradication in conjunction with Article 55 paragraph 1 of the Criminal Code in conjunction with Article 64 paragraph 1 of the Criminal Code, with imprisonment of minimum 3 years and maximum 15 years and a fine of Rp 150 million to Rp 750 million.
