REPUBLIKA.CO.ID, JAKARTA -- Deputy Attorney General for General Crimes Noor Rachmad said case file against religious blasphemy allegation with Basuki Tjahaja Purnama (Ahok) as suspect has complete the formal and material requirements (P21). Therefore, the evidences and suspect could be brought into court. "Right now, the suspect is still belongs to the National Police and we wait the hand over," Noor said.
According to Noor, his duty as research investigator already finished. Will Ahok be arrested? Related to the people's aspiration on Ahok imprisonment, Noor said the police investigator has the responsibility. "Meanwhile, we are still preparing indictment voiolation against Article 156 and 156a of the Criminal Code," Noor said.
National Police's Criminal Investigation Department (Bareskrim) will hand over evidences and suspect to Attorney General Office on Thursday or not later than Friday. Previously, on Tuesday (11/29), National Police's Chief of Public Relations Inspector General Boy Rafli Amar assured the maximum date is December 2. "After that, we will prepare indictment and send it to the court," Noor explained.
Legal practitioner Ikhsan Abdullah said the police investigator must immediately handed evidences and the suspect. Prior to the handed over to the Attorney General Office, National Police should arrest and detain Ahok first. "The police investigator will violate Code of Criminal Procedure Act No. 8 of 1981 Article 8 paragraph 2 and 3 if they did not arrest and detain Ahok," he remarked.
The Attorney General Office then could decide wheter Ahok should be detained for the next 20 days or be released. "The most important thing is legal certainty and justice," he said.
