Police comments on Habib Rizieq's SP3 appeal

Habib Rizieq's lawyer says the police has the authority to drop the case.

REPUBLIKA.CO.ID, JAKARTA -- National Police spokesman Setyo Wasisto said there has been no decision yet to the appeal to drop Habib Rizieq Shihab's alleged steamy conversation case.  The discourse re-emerged following the news of Habib Rizieq's plan to return home. 

"The investigators have the rights whether to drop or continue the case," said National Police spokesman Setyo Wasisto on Monday (Feb 19).

Earlier, lawyer Kapitra Ampera said the police should issue Letter of Termination of Case Investigation (SP3) on his client's case. He believed the case is formally defect. Nevertheless, he seemed reluctant to discuss the possibility of SP3 issuance. Moreover, the police has never respond to his request and Habib Rizieq unlikely to return from Saudi Arabia on February 21.

"I think we should not discuss the SP3. It is the police's authority. Let's wait and see," he said when contacted by Republika.co.id

Habib Rizieq flew to Saudi Arabia along with his family for umrah pilgrimage on April 26, 2017. On May 29, 2017, Jakarta Metro Police determined him as suspect in sexually explicit WhatsApp chats allegedly exchanged between him and Firza Husein.

He missed police summonses to be questioned as witness. The police put his name on the wanted list. 

On July 27, 2017, police investigators questioned Habib Rizieq at Saudi Arabia. "He is cooperative during the examination. We will re-summons him when he gets back, if necessary," National Police chief Tito Karnavian said on Friday (August 18, 2017). 

The police did not took Habib Rizieq home. They let the Islamic Defenders Front's leader to perform hajj and prefered to wait him to come home.

Habib Rizieq threatened with Article 4 paragraph 1 juncto Article 6 juncto Article 32 and Article 9, juncto Article 35 Law No. 44/2008 on pornography.
