Without president's signature, MD3 Law remains valid

If the president does not sign MD3 Law within 30 days, it will still remain valid.

REPUBLIKA.CO.ID, JAKARTA -- House of Representatives (DPR) said the second revision of Law No. 17/2014 on Legislative Institutions (MD3) remained valid even though President Joko Widodo (Jokowi) does not sign it. The condition has been regulated in Law No. 12/2011 on Establishment of Legislation.

"It's President's authority, but indeed in the regulation if president does not sign it in a certain period, it is not considered as refusal. So it can still be implemented," said House Deputy Speaker Agus Hermanto on Wednesday (Feb 21).

In Article 73 paragraph 2 Law No. 12/2011 stated if draft law (RUU) is not signed by president within 30 days since draft law is approved, the draft of law is valid and shall be enacted. Agus said president refused to sign MD3 Law due to situation recently. Such as, the insistence to test the materials of MD3 Law.

According to Agus, the adoption of the MD3 Law in the Plenary Session of the House of Representatives was based on the agreed terms of all the processes until it was legalized. "We oversee the process and we carry out what has been agreed," Agus added.

In addition, Agus said House of Representatives has invited the people to submit a judicial review of the revised MD3 Law, especially on the new articles which are considered controversial. He explained the existence of the material test suit does not indicate the MD3 Law discussed in a hurry. "It's an inseparable part of legislation," he said.

Earlier, President Jokowi was surprised by the second revision of MD3 Law. Minister of Law and Human Rights, Yasona H Laoly said president will not sign it yet and possibily will not sign it.

According to Yasonna, there are many problems in MD3 Law. A number of articles are considered inappropriate, such as the immunity rights for House of Representatives members and the articles of contempt.
