Legal process against Pilkada candidates to be postponed

REPUBLIKA.CO.ID, JAKARTA -- The Attorney General Agung HM Prasetyo has said that any legal process against regional head candidates who take part in the coming local elections would be postponed until after the elections are done. The policy, he said, is aimed at assuring smooth process of the election.

"It would not be stopped, but after the completion of the regional elections (Pilkada) it (the legal process) will be proceeded," Prasetyo said on the sideline of the signing of agreement between the Attorney General Office and the Ministry of Village, Disadvantaged Region Development and Transmigration here on Thursday.

Prasetyo said law enforcement could bring justice and give legal certainty, but the state has a bigger task for now, which is organizing the simultaneous regional elections.

However, it would be a different situation if a candidate had been involved in a legal case before he or she was declared as a candidate by the General Election Commission (KPU), he added.

Earlier on Wednesday, the Corruption Eradication Commission (KPK) stated that it would continue the legal process against regional heads allegedly involved in graft cases, despite their candidacy in the regional election.

"For legal process, of course KPK in its law enforcement process would carry on as usual, because the legal basis is the criminal code procedures, law on corruption eradication and law on KPK. As long as we have the regulation there, we will continue the process," KPK spokesman Febri Diansyah said.

On Monday, the Coordinating Minister for Political, Legal, and Security Affairs Wiranto has asked the anti-graft body to postpone naming of election candidates as suspects in graft cases.

The measure is aimed at assuring smooth process of simultaneous regional elections and avoiding any disruption in the candidacy due to the legal process.

"For regional election, KPK has given its full support to the process, such as in (graft) prevention, through the candidates' wealth reporting. We have facilitated this," Febri said.
