Jakarta Public Order officers to monitor sealed islets

All activities in reclamation islets has to be stopped following the sealing.

REPUBLIKA.CO.ID, JAKARTA -- The Jakarta Governor, Anies Baswedan, has said Public Order Agency (Satpol PP) officers will monitor islets C and D in Jakarta Bay on the northern coast after they sealed hundreds of buildings. The Satpol PP will monitor the locations to ensure there will be no activities in the islets, Anies said on Thursday.

Earlier in the day, the Governor had deployed 300 Satpol PP officers to seal buildings on reclaimed islets C and D. The buildings, which were developed by PT Kapuk Naga Indah, a subsidiary of the Agung Sedayu Group, were reportedly constructed without building permits (IMBs).

He called on the parties concerned to adhere to the rules before starting a construction process. "Do not reverse the process to build first and get the licence later. But be sure to have the licence before you start construction," said Anies.

The Jakarta administration, he said, would finalize the draft on regional regulations and establish the necessary agencies as stipulated by the Presidential Regulation no. 52/1995 on reclamation of the northern coast of Jakarta. "We will arrange this. Not only for C and D islets but all areas on the northern coast of Jakarta, so there would be integrated planning," said Anies.

The authorities have put some banners saying the location had been sealed by the Jakarta administration for violation of article 69 (1) of the Law no. 26/2007 on spatial planning.

Rights to build

Previously, Anies also insisted that the issuance of HGB for islet D and 2A was not fit the procedue. According to him, before the issuance of certificate, there must be local regulation (perda) first. In fact, local regulations related to reclamation on Jakarta Bay is currently withdrawn by the provincial government to be renewed.

"So if we look about local regulation on Zoning, it's still not exist yet and we can't manage the land if local regulation still in the process," Anies explained.

Anies has sent an official request to postpone or repeal rights to build (HGB) of reclamation islets to Ministry of Agrarian Spatial Planning/National Land Agency (BPN). However, Ministry of Agrarian Spatial Planning/National Land Agency (BPN) refused to repeal HGB of reclamation islets on Jakarta Bay.

BPN has assessed that the issuance of rights to build (HGB) was in accordance with the legal procedures. "The issuance of HGB over the Management Rights (HPL) of Islet D was carried out based on the request of Jakarta Provincial Government and it's in accordance with the provisions of the prevailing land administration," said BPN in a statement on Thursday (January 11).

BPN also advised Jakarta Provincial Government to take the legal step through State Administrative Court (PTUN), in order to repeal HGB certificate of the reclamation islets. The ministry said, they had non-retroactive stance, which could not repeal the agreement unilaterally.

Meanwhile, inaugural session of HGB of D reclamation islet hearing has been held by State Administrative Court (PTUN) Jakarta on Monday (May 28). The hearing was done upon petition filed by Coalition to Save the Jakarta Bay (KSTJ) against the head of North Jakarta Land Administration Office.
