REPUBLIKA.CO.ID, JAKARTA — DKI Jakarta Attorney stated teenager who allegedly insults and threat President Joko Widodo (Jokowi) through social media post was not detained after the case administration entered second phase by Jakarta Police investigators. Earlier, RJT has been determined as child dealing with law.
Teenager with initials RJT was not detained due to he was threatened under seven years imprisonment. It was also in accordance with criminal justice system of children.
"He is not detained in accordance with Article 32 paragraph (2) Law No. 11/2012 on Criminal Justice System of Children," said DKI Jakarta High Attorney law information section head, Nirwan Nawawi on Friday (July 27).
The second phase of case delegation is the delivery of evidence and suspects from Jakarta Police investigators to prosecutor's office after the case was declared complete or P-21. According to Article 32 paragraph (2) Law No. 11/2012 stipulates that the detention of a child may only be made on the condition that the child is 14 (fourteen) years old, or allegedly committing a criminal offense punishable with imprisonment of seven years or more. If the period of detention referred to above has expired, the child shall be expelled from detention by law.
RJT is snared with Article 27 verse 4 juncto Article 45 Law No . 19 Year 2006 on Information and Electronic Transactions (ITE) with threat maximum 6 years. The evidences that presented in the case was a flash disk contains video from Instagram.
A video of RJ went viral on social media Instagram and first uploaded by account @jojo_ismyname. The shirtless young man posed a threat and challenged president while holding a frame of Jokowi's photograph.
RJT said he created the video to answer a challenge from his friend. He explained his friend challenged him to see whether the action will draw polices attention and resulted with an arrest He accepted the challenge and his friend recorded the video.
