Habib Bahar to be tried soon for assault against minors

REPUBLIKA.CO.ID, BANDUNG — A case of alleged assault against minors involving Habib Bahar bin Smith (HBS) as suspect has entered a new phase. The case file was delegated by Cibinong District Attorney (Kejari) to the Bandung District Court on Tuesday (Feb 19).

"The file has been transferred to the Bandung District Court today," said the spokesperson of West Java High Prosecutor's Office, Abdul Muis Ali, to reporters.

Before being delegated, said Ali, Kejari Cibinong sent a written request to the Supreme Court (MA) so that the trial could be held at the Bandung District Court. The request, he said, was approved by the Supreme Court through the Supreme Court Decree Number 24 / KMA / SK / II / 2019.

He said, the basis for filing a letter to the Supreme Court was Article 85 paragraph 2 of the Criminal Procedure Code. "Thus the file already exists in the Bandung District Court,'' he said.

According to Ali, the file delegated to the Bandung District Court consisted of three files of three suspects, HBS, AY, and MAB. To handle the HBS case, the prosecutor's office involved a joint team of 10 prosecutors from Kejati Jabar and Kejari Cibinong.

The three files was delegated at the same time. He said the judge at the Bandung District Court has the authority to detain the three suspects.

HBS was named a suspect in the case of alleged assault against two teenagers MHU (17 y.o) and ABJ (18 y.o). The police then arrested the suspect and ensnared him with layered articles namely Article 170 paragraph (2), Article 351 paragraph (2), Article 333 paragraph (2), and Article 80 of Law Number 35 of 2014 concerning Child

Protection.

The case started from a video uploaded to the internet which shows two children acted as if they were Habib Bahar. They conducted behaviors which should not be carried out by an ulama.

For example, the video recorded a teenager who was smoking while driving a car with his feet, then asks for money to and fro, and other attitudes again, making bad image of a habib. Apart from all the reasons, Habib Bahar's lawyer Sugito Atmo Pawiro said, he agreed that his client was indeed guilty in this position. However, he felt strange, children who acted like thugs were not examined.
