Mother and Her Baby in Aceh Imprisoned for the ITE Law

Indonesia police prefer to settle this case with a restorative justice approach

REPUBLIKA.CO.ID -- The case of a mother who was detained with her baby has entered into court proceedings.

JAKARTA -- Police Public Relations Division Brigadier General Rusdi Hartono said that the case of a mother named Isma Khaira (33) who was detained with her baby has entered the court process.

However, after the National Police Chief Listyo Sigit Prabowo issued a message regarding the handling of the Electronic Transaction and Informations Law (ITE) case, then the police put forward restorative justice.

This case began when Isma recorded a video of a village head fight in North Aceh. Then she uploaded it on her social media account. However, the village head did not accept Isma's post and reported it to the police with a complaint of defamation.

Furthermore, based on the village head's report, Isma was found guilty and sentenced to three months in prison by the Lhoksukon District Court. As a result, Isma and her baby started going to prison on February 19, 2021.

"The Police will prioritize restorative justice, open the widest possible mediation space," said Rusdi in a press conference at Police Headquarters, South Jakarta. Wednesday (3/3).

Furthermore, said Rusdi, if the mediation process is not achieved then law enforcement will still be carried out but the police will not arrest them. According to him, the National Police really puts law enforcement into the final process.

"So the mediation process that will be put forward in handling cases related to the ITE Law is especially personal," said Rusdi.

Rusdi emphasized that if there is a violation of the law that will have an impact on dividing the nation, it will lead to horizontal conflicts in the midst of society, the police will take firm action against all of them. This is different from interpersonal related cases.

"If the nation has divided, divided, disturbed public order, the police will act decisively," said Rusdi.

Restorative justice is an effort to restore the rights of victims while still holding the perpetrators accountable by means of reconciliation. The aim of a restorative justice is to create harmony for the victim so that the dispute resolution is restorative.
