Is it a sin to keep it a secret? <br /><br />Reported in About Islam on Thursday (7/12/2023), Muslim scholar from Canada, Sheikh Ahmad Kutty said in Islam marriage must meet certain minimum standards and requirements in order to be valid and acceptable. Without meeting these requirements, marriage is invalid and unacceptable. <br /><br />It is therefore all difficult to distinguish from fornication or forbidden relationships. The minimum legal requirements for marriage are as follows: the consent of the female guardian, the presence of witnesses, offerings and acceptance, and finally the dowry (dowry). <br /><br />“If the above conditions have been met, the marriage is valid. However, if those conditions are not met, then the marriage becomes void,” Sheikh Kutty said. <br /><br />As for the guardian's consent, he said, it can only be dispensed with if the guardian simply refuses to give consent for reasons other than Islam. In this case the judge can certify the marriage after going through the legal process. <br /><br />On the contrary, he stressed, if such does not happen and no effort is made to ensure the consent of the guardian, then the marriage is invalid and therefore unacceptable in Islam. <br /><br />As the Prophet said, “There is no marriage without a guardian and two trustworthy witnesses. “(HR. Abu Dawud). <br /><br />As for publicizing marriage in Islam by establishing the conditions of marital validity mentioned above, he said, Islam insists marriage should remain distinct from other free and immoral lifestyles such as fornication and infidelity. <br /><br />Therefore, the Prophet insisted or rather advocated to announce the marriage. Based on the above description, the concept of marriage “only for the two of you or for Allah” is unacceptable in Islam. Society has a stake in marriage in the sense that society must know that a married couple is married so that they do not suspect that they are in an illicit relationship. <br /><br />According to Islamic teachings, Muslims are obliged to do whatever they can to preserve religion, honor, and dignity. REPUBLIKA.CO.ID, JAKARTA -- Minister of Women's Empowerment and Child Protection (PPPA) Yohana Yembise has proposed a minimum age of marriage, namely 20 years for women and 22 years for men. The proposal came following the decision of the Constitutional Court (MK) on Law Number 1 of 1974 about marriage.
"The age is most appropriate when compared with other countries on average, specifically for women 20 (years) and men 22 (years)," Yembise remarked, after attending the Submission of the Parahita Ekapraya Award (APE) at the Vice President's Palace, on Wednesday.
The proposal is currently being prepared by the PPPA Ministry to be brought to the DPR (the People's Consultative Assembly) during the discussion of the revisions to Law Number 1 of 1974 concerning marriage. Yembise assessed that the proposed minimum age for marriage is fair in terms of gender equality, and does not violate the provisions of the law on child protection related to the minimum age for marriage.
"This is another approach by the DPR, so that there would be a mutual agreement. What is clear is that the law would protect children who are at least 18 years old," she added.
The Constitutional Court canceled Article 7 paragraph (1) of Law Number 1 Year 1974 concerning marriage which regulates the minimum age for marriage, namely 16 years for women and 18 years for men. The court considered the article to be discriminatory and unconstitutional, because it distinguished the minimum age limit for marriage between men and women.
This is considered to be able to cause discriminatory cases and domestic violence which are more detrimental to the women's side, so that they are constrained in fulfilling their constitutional rights.
"Constitutional rights are meant, among other things, for equal treatment before the law, as stipulated in Article 28D paragraph (1) of the 1945 Constitution," Constitutional Justice Wahiddudin Adams revealed.
According to the Child Protection Act, a woman at the age of 16 is still classified as a child. Therefore, if she is married, her status will change to an adult.

But like many unions in China this is a marriage that won't last long. In fact, their wedding is a piece of performance art staged by an artist known as Nut Brother.
The two strangers have been brought together to tie the knot then divorce within 48 hours in an attempt to stir debate about the meaning of the institution of marriage in modern China, which has a soaring divorce rate.
"I have a lot of friends who have been forced to get married. Marriage has taken on a lot of things it shouldn't, it has become mixed up with things like sex, property, care for the elderly and social stability," said Nut Brother.
The decision to get married in China has long been a family affair, with parents traditionally having the last word on their children's spouses.
With a patchy social welfare system and Confucian expectations that the younger generation will take care of the old, questions of material wealth are often more important than compatibility when young people come under pressure to get married and produce the next generation of the family line.
Young people who decide they do not want to tread the traditional marriage path find themselves fighting against established values championed by those at the very top.
"No matter how much times change, no matter how much social structures change, we must all emphasise building a family," President Xi Jinping declared in a Spring Festival address last year.
Traditional Chinese family values were key for social harmony, he added.
But as traditional notions of family obligations increasingly come into conflict with more individualistic aspirations, the divorce rate has soared.
From 2011 to 2014, the most recent years for which data is available, the number of divorces increased by 27 percent, fuelled in part by those who find it impossible to maintain a marriage that might appear rosy but lacks real love.

According to Judge Arief, the petition filed by the applicant has no legal grounds. The judge said interfaith marriage in Indonesia is considered illegitimate, such as regulated and stated in Law Number 1 of 1974 about Marriage Article 2 (1).
Previously, the judicial interfaith marriage filed by Damian Agata Yuvens, Rangga Sujud Widigda, Varita Megawati Simarmata. In their petition, the applicant felt their constitutional rights could potentially be harmed by the enactment of the requirement of marriage validity according to religious law. REPUBLIKA.CO.ID, JAKARTA -- President Joko Widodo will carry out his state duties as usual, despite the upcoming nuptials of his eldest son in Solo, Central Java, Cabinet Secretary Andi Widjajanto said here on Tuesday.
"The president will conduct all activities as usual. He has assistants to help him deal with tasks," he stated after a limited cabinet meeting at the president's office.
According to Widjajanto, he could even hold a cabinet meeting in Solo if required.
"The president will continue to work as usual as even a limited cabinet meeting could be held there (in Solo) if needed," he remarked.
President Joko Widodo left his office after holding a limited cabinet meeting at 1:45 p.m. for Halim Perdanakusuma Airport to go to Solo, his hometown, for his son's wedding.
