Golkar: Prabowo Has Preference to Add Ministry

Baleg is known to initiate discussion of revised State Ministries Law.

REPUBLIKA.CO.ID, JAKARTA -- Golkar Party DPP Chairman Ace Hasan Syadzily said that Prabowo Subianto certainly has considerations to add or not add ministries to his cabinet. Especially if its addition is made through the revision of Law No. 39 of 2008 on the Ministry of State.

It is known that the Legislative Body (Baleg) of the Parliament will start the discussion of the revision of the Law on the Ministry of State on today. At today's meeting, Baleg will listen first to the expert draft review from his side.

“It is very important that we see that people also vote for elections that definitely have preferences. Well, the preference is yes, I guess according to what the president's visions are,” Ace said at Nusantara II Building, Parliament Complex, Jakarta, Tuesday (14/5/2024).

Ace was then asked whether it was true or not about the existence of a special ministry dealing with the free lunch program. With it or not, it is certainly Prabowo's right as president-elect to make that happen.

“So therefore I think it is not impossible if the process of the needs of the ministry portfolio should be adapted to the visions and programs offered by the cabinet,” Ace said.

In recent days, the issue of adding ministries in the Prabowo-Gibran government has ballooned, from 34 to 40. The rules for the addition of ministries are laid down in Law No. 39 of 2008 on the Ministry of State.

Chapter IV of the Law on the Ministry of State, provides specifically for the establishment, replacement, and dissolution of ministries. In Article 12 of the law, there are three ministries that must be established and may not be dissolved as a mandate of the Basic Law (UUD) 1945, namely the Ministry of Foreign Affairs, the Ministry of Defense, and the Ministry of internal affairs.

Further in Article 13 Paragraph 2 of the Ministry of State Law, there are four considerations in forming a ministry. The four are efficiency and effectiveness; the scope of the task and the proportionality of the task load; the continuity, consistency and coherence of the implementation of the task; and/or the development of the global environment.

“In the interest of synchronizing and coordinating the affairs of ministries, the president may establish a coordinating ministry,” Article 14 reads.

“The total number of Ministries referred to in Article 12, Article 13, and Article 14 is at most 34,” reads Article 15, which renders the issue of adding the Prabowo-Gibran era ministry to 40 impossible.
