REPUBLIKA.CO.ID, JAKARTA -- Head of the general prosecutor in the case of alleged religious blasphemy with Basuki Tjahaja Purnama (Ahok) as defendant, Ali Mukartono, said it was inappropriate for the defendant to deliver his exception at the inaugural session of the trial conducted on last Tuesday (Dec 13). Supposedly, Ahok filed it in a pretrial hearing. "If there was any objection related to the determination of suspect which do not fit the legal process and violating human rights, it should be filed in a pretrial," Ali stressed on Tuesday.
According to the prosecutor, the legal process of the defendant is in conformity with the provisions of law. Previously, Ahok's legal advisor considered the legal proceeding was too fast and out of the ordinary. "We did not have to use the whole 14 days to process it. When all file is complete, in accordance with Article 136, we could transferred the case to the court," Ali remarked.
Therefore, based on the analysis and juridicial, the prosecutor said the exception filed by the defendant and his attorney has no legal basis and deserve to be rejected. Judges of the North Jakarta District Court decided to postpone the trial for a week to hear interlocutory judgment. "The trial will be resumed at December 27 and with the presence of the defendant," Head of judges panel, Dwiyarso Budi Santiarto.
