REPUBLIKA.CO.ID, JAKARTA -- The government will use the recent decision of the Administrative Court as a reference to execute drug convict Sergei Aresly Atlaoui, Attorney General HM Prasetyo said here on Wednesday.
"We appreciate the court's decision. Appreciate our stance of using the court's ruling as our reference," he said after meeting wth Vice President Jusuf Kalla at the latter's office.
HM Prasetyo admitted he had not reported to the President with regard to the decision of the Administrative Court to reject Sergei's lawsuit against President Joko Widodo's decision to refuse clemency.
"He (the President) has known me well. The news has also been reported widely by the media," he added.
Sergei who is a French national has filed a lawsuit against President Joko Widodo's decision number 71/G/2015 to reject clemency for Sergei.
The East Jakarta administrative court's decision means execution of Sergei will be implemented.
Regarding when the execution would be carried out Attorney General Office spokesman Tony Spontana had confirmed that it would not be done during the month of Ramadhan.
"I can confirm that it would not be done soon in the current month of Ramadhan. You don't think it is wise to do in the month of Ramadhan, do you?. So, let us wait until after the fasting month," he said.
Sergei Atlaoui was sentenced to life imprisonment by the Tangerang district court and the ruling had been reaffirmed by the High Court. However Ataloui's appeal to the Supreme Court was rejected and his sentence had even been increased to death and his plea for a presidential pardon had also been turned down by President Joko Widodo in December 2014.
Sergei Atlaoui was caught by the police at a narcotics factory in Cikande, Tangerang, Banten, in 2005.
Atlaoui's execution in April 2015 was postponed after he filed a lawsuit against the President's decision to give clemency.
In a judicial court in March Sergei denied that he was involved in narcotic drug production in Cikande.
