REPUBLIKA.CO.ID, BANDUNG -- High Court of West Java have not received the case file of alleged insult on state emblem and defamation of former President Sukarno involving high priest of Islamic Defenders Front (FPI) Habib Rizieq as the suspect.
However, Head of West Java's High Court Setia Untung Arimuladi said the police has sent letter announcing the investigation on the case. "Better ask the police about the case file transfers," he said at his office on Monday.
On January 30, the investigator of West Java Police has elevated Habib Rizieq status from reported witness to suspect. It was decided after three series of case screening. "After seven hours of case screening, we officially named Habib Rizieq as suspect," Spokesperson of West Java Police, Sr. Yusri Yunus said.

According to Yusri, from case screening, the police concluded there were criminal aspect in the case. The police already have evidences, among other videotape. Based on forensic report, the videotape was said to be original. "Currently, we are still completing the case file," he said to Republika.co.id, on Monday.

Yusri said Habib Rizieq was charged under two articles, namely Article 164 on the defamation of a state symbol (Pancasila) and Article 320 of the Penal Code on defamation. As a suspect, he said, Habib Rizieq would not be subjected to detention because both articles' penalty was under five years.
