REPUBLIKA.CO.ID, JAKARTA -- Indonesia's government does not have to issue a regulation in lieu of law (Perpu) on regional elections (Pilkada) regarding a prospective regional head named as a graft suspect by the Corruption Eradication Commission (KPK). Observer said no legal vacuum in handling the case.
"The government does not have to issue a Perpu, as the electoral mechanism can still run, as regulated in the Law on Regional Head Elections without the Perpu, since there is no legal vacuum or urgent event," Independent Election Supervisory Commission (KIPP) Secretary General Kaka Suminta remarked in a press statement on Thursday.
Suminta noted that the KPK's move to name one of the candidates for regional head in North Maluku as a suspect in a corruption case was an ordinary legal action that must be taken by the anti-graft body.

To this end, Suminta regretted KPK Chairman Agus Rahardjo's proposal for the government to issue a Perpu on Pilkada.
"It does not come under the KPK's authority, and it is not necessary to issue statements that could trigger legal polemics in the realm of politics. The KIPP believes that the KPK, as a law enforcement agency, does not need to convey this, and the anti-graft body should focus on its duties and authorities in eradicating corruption," he emphasized.
