MUI decides on property from corruption and death sentence for the perpetrator

REPUBLIKA CO. ID., JAKARTA - Indonesian Council of Ulama (MUI) fatwa strengthens law enforcement institute in seizing corruptors' assets. Based on the fatwa (Islamic verdict -Ed), the corruptors will not only execute the court verdicts, but also give up their property from the corruption. And to a certain level, the perpetrator must be sentenced to death.

The Chairman of MUI on fatwa, KH Ma'ruf Amin, said the fatwa was the agreement of 800 ulamas attending the meeting in Pesantren Cipasung, Tasikmalaya, West Java, on Sunday. He added, the property of the corruptors, such as money, car, and house, should be confiscated if those are proven from the corruption.

"The seized assets can be in any form according to the verification of law enforcement," Amin said. 

Corruptors, he continued, inflicted heavy losses to the state because they misuse of power for their own interests. But, if the property is not proven to be the treasure from the corruption, the state cannot seize them. While the Chairman of MUI, KH Cholil Ridwan, said that corruption was also an act of treason to the country so at certain level, the perpetrator should be sentenced to death. 

The Coordinator of Corruption Division in Indonesia Corruption Watch (ICW), Ade Irawan, said the confiscation not only gave deterrent effect for the corruptors, but also was the right form of punishment for them. The corruptors should replace or return the state losses.

Yet, Deputy Chairman of Corruption Eradication Commission (KPK), Zulkarnain, said Indonesia faced some difficulties in seizing the assets. "Even though Indonesia reaches some progress in returning the assets from the corruption, Indonesia still faces difficulties in returning the assets abroad," he said.

Mereka meminta fatwa kepadamu (tentang kalalah). Katakanlah, “Allah memberi fatwa kepadamu tentang kalalah (yaitu), jika seseorang mati dan dia tidak mempunyai anak tetapi mempunyai saudara perempuan, maka bagiannya (saudara perempuannya itu) seperdua dari harta yang ditinggalkannya, dan saudaranya yang laki-laki mewarisi (seluruh harta saudara perempuan), jika dia tidak mempunyai anak. Tetapi jika saudara perempuan itu dua orang, maka bagi keduanya dua pertiga dari harta yang ditinggalkan. Dan jika mereka (ahli waris itu terdiri dari) saudara-saudara laki-laki dan perempuan, maka bagian seorang saudara laki-laki sama dengan bagian dua saudara perempuan. Allah menerangkan (hukum ini) kepadamu, agar kamu tidak sesat. Allah Maha Mengetahui segala sesuatu.”

(QS. An-Nisa' ayat 176)
