Fishermen win in reclamation trial, Jakarta provincial govt file an appeal

REPUBLIKA.CO.ID, JAKARTA – The lawsuit from Jakarta Bay fishermen and the environmental organization due to the reclamation of K Island were favored by Chairman of the Panel of Judges M Arief Pratomo. The verdict was read in the Administrative Court, Pulogebang, East Jakarta on Thursday (March 16).

By the verdict, the inactive Jakarta Governor Basuki Tjahaja Purnama (Ahok) is ordered to temporarily stop the Jakarta Bay reclamation project in K Island. "In principal, (panel of judges) entirely favored the lawsuit by the rapporteur (and) stated the license of reclamation of K island as invalid,” said Arief.

The panel of judges postponed the trial. It would be continued by reading the verdict of the lawsuit of F and I islands. The fishermen expressed their happiness for the judges’ decision. “Viva fishermen, viva fishermen!” shouted them in Kartika Room.

The lawsuits of the three islands had been made by the traditional fishermen community (KNT) and the environmental organization Walhi since 2016. It was registered under the number 15/G/LH/2016/PTUN.JKT. The panel of judges had made the decision today after conducting several trials.

Previously, the fishermen’s lawsuit for the reclamation license of G island in Jakarta Bay issued by Jakarta governor Basuki Tjahaja Purnama alias Ahok were favored by the panel of judges of the Administrative Court (PTUN), Pulogebang, East Jakarta on Tuesday (May 31, 2016).

Ahok win the appeal in the High Administrative Court (PT TUN) for the verdict by PTUN. The reclamation of G Island was then continued. The legal team of the fishermen submitted an appeal to the Supreme Court.

The lawyer of the fishermen, Martin Hadiwinata said he was sure for winning the G Island in Supreme Court. “We are still optimistic. We keep struggling (for G island),” said Martin.
