REPUBLIKA.CO.ID, JAKARTA -- Jakarta governor Anies Baswedan pledged not no tolerate any violation done by the developers of Jakarta Bay reclamation project. He said, violation and additional contributions to the capital city given by the developers are two different things.
"Violation is violation. It can't be justified by saying you have contributed to the city," said Anies on Tuesday (January 16).
Anies insisted that the issuance of rights to build (HGB) of 2A or D reclamation islets was not in accordance with the procedure. He said the sequence was wrong and the zoning plans bylaws must exist first.
Anies has sent the second official request to postpone or repeal HGB of reclamation islets to Ministry of Agrarian Spatial Planning/National Land Agency (BPN). In his new letter, he showed various evidences of administrative error related to HGB issuance.
According to Anies, BPN is able to postpone or repeal HGB based on Regulation of Agrarian Minister No. 9/1999. In Articles 103 to 133, he said, the cancellation of HGB certificate can be done without court process.
On January 11, BPN has refused Anies's first appeal to repeal HGB of reclamation islets on Jakarta Bay due to the issuance was in accordance with the legal procedures. BPN believed issuance of HGB over the Management Rights (HPL) of Islet D was carried out base on the request of Jakarta Provincial Government and in accordance with the provisions of the prevailing land administration.
