REPUBLIKA.CO.ID, JAKARTA -- Interim Chairman of the Corruption Eradication Commission (KPK) Nawawi Pomolango ordered a number of anti-corruption agencies to gather information on allegations that German software company SAP bribed officials in Indonesia.
“(Regarding) SAP, I have asked directly the director of the investigation and also the director of PLPM (Community Report and Complaint Service) to immediately carry out some kind of information materials gathering against it,” Nawawi said in his statement in Jakarta, Wednesday (17/1/20234).
Nawawi also asked the public to be patient until it is fully informed about the news of the alleged bribery. “So, in the meantime, we are waiting to see what the results of the process will look like and maybe in the future they will file some kind of investigation warrant; what is important from the informations gathering, they did find everything that concerns this SAP,” Nawawi said.
One of the parties in the Indonesian Government who allegedly received bribes from German companies is the Ministry of Marine and Fisheries (KKP). Related to that, Minister of Marine and Fisheries Sakti Wahyu Trenggono said his agency was conducting an investigation related to alleged bribes by SAP that dragged the CCP.
Trenggono admitted that he only learned about the bribery case that occurred in 2015-2018. Currently, it is identifying traces of projects as well as applications from SAP relating to the case.
“I also just found out, yes, but I again identified in the application what, the application does not know yet. That was in the past, in the period from 2015 to 2018. There should have been a trace. That is, the application exists. It's an app company, but we don't exist yet. So, that's another one we're looking for,” Trenggono said.
Later, the Telecommunications and Information Accessibility Agency (Bakti) of the Ministry of Communications and Informatics (Kominfo) also allegedly received bribes from SAP. Bakti Kominfo stated that it is committed to fully supporting law enforcement over bribery cases from one of Germany's foreign software companies, SAP.
Bakti Kominfo will expressly conduct internal checks and coordinate with relevant authorities to ensure its ranks are properly served and support the smooth devolution of the bribery case.
“Bakti is committed to upholding law enforcement and will work with relevant authorities to support the inclusive and sustainable management of the State Budget towards a developed, prosperous, prosperous and corruption-free Indonesia,” Bakti Kominfo said in a statement.
For the record, the U.S. Department of Justice, on Wednesday (10/1/2024), released information that it has imposed a $220 million fine on a German software company, SAP SE, for violating the Foreign Corrupt Practices Act. The fine was imposed on SAP SE in connection with bribery cases against government officials in South Africa and Indonesia.
“SAP bribed officials at state-owned enterprises in South Africa and Indonesia to obtain government business,” said Acting Assistant Attorney General for the Criminal Division of the U.S. Justice Department, Nicole M. Argentieri, in a statement on the U.S. Department of Justice's official website.
According to court documents, SAP through several parties was found to have bribed by providing economic goods, cash, political donations, money via transfers, and luxury goods to officials in South Africa and Indonesia.
In the period 2015-2018, SAP through its representatives was involved in bribery attempts against Indonesian officials in order to profit and win various contracts in the Ministry of Marine and Fisheries (KKP) and the Telecommunications and Informatics Financing Providers and Managers (BP3TI), now called Bakti Kominfo.
